Customer Agreement / Terms & Conditions:

A.  Introduction
  1. You can place orders with CCbV online at http://www.verrice.com, by phone at 847-420-9196, or via email at sales@verrice.com.
  2. These options are collectively referred to as the "Services"/"Service".
  3. The terms and conditions contained in this document ("Customer Agreement / Terms and Conditions") apply to purchases made using any one of the Services.
  4. Throughout these Terms and Conditions, the terms "CCbV, Custom Computer by: Verrice, we, our, us" refers to the Illinois sole proprietorship Rangval Walker III (IBT# 3928-5685).
  5. Access to the Services will require user registration. Subsequent access to the Services will be subject to a valid member email address, and registered password ("Password Details"). The information that you provide must be accurate and complete. All Password Details are accepted and may be withdrawn at our sole discretion and are exclusive to you and non-transferable. You are responsible for maintaining the confidentiality of your Password Details to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or using your Password Details. You should take all necessary steps to ensure that your Password Details are kept confidential and secure and you should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.
  6. By using the Services you are indicating your acceptance to be bound by these Terms and Conditions. They form a legal agreement between you and us and can only be amended with our consent. Any purchases you make are subject to these Terms and Conditions.
  7. We reserve the right to change these Terms and Conditions from time to time without prior notice, provided that any such change will not affect any purchases you have made before the change is implemented. Your continued use of the Services shall signify your acceptance to be bound by the latest Terms and Conditions. B. Ordering
  1. For details on how to place an order to purchase a product from CCbV you should refer to the relevant Services information at http://www.verrice.com. Whichever Service you choose for your order, you will have an opportunity to check through and correct any input errors in your order up until the point at which you place your order.
  2. All orders placed by you are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. We may also close your account for any reason and will not be liable to you or to anyone else in those circumstances.
  3. As we deal in custom equipment design and sales, orders will rarely be from stock inventory, are subject to parts availability, and will require wait-time between order acceptance and order shipping. See Section C below for further information.
  4. Acceptance of your order and the formation of a contract between us will take place when we dispatch the products ordered to you, unless we have notified you that we do not accept your order or you have cancelled it in accordance with Section G below.

C. Parts Availability

  1. Due to the nature of custom ordering computers, parts are subject to availability. When a part becomes discontinued or unavailable at quoted pricing or delayed, an exception will occur. Should an exception occur with your order, you will be contacted by us to discuss the matter.
  2. No substitutions shall be made without your approval.
  3. In the event of a discontinuation exception, we will attempt to locate the closest suitable and similarly priced part and provide you the option to alter or cancel your order.
  4. In the event of a price exception, we will attempt to locate the next best possible price and provide you the option to accept the price change, create a substitution amendment to your order, or cancel your order.
  5. In the event of a delay exception, we will attempt to locate the part at a more reasonable delivery time with the next best possible price and provide you the option to accept the delay with the original price, accept a price change for improved delivery, create a substitution amendment, or cancel your order.
  6. Cancellations made in accordance with the above exception rules will incur no penalty to you or your account.

D. Prices
  1. All prices are in U.S. Dollars ($ / USD), and exclude delivery, installation, and taxes.
  2. Delivery charges, where applicable, are clearly displayed when you view the products you have selected within your basket or are given to you by our telephone operative when your order is placed. Delivery charges will be added to the total amount due once you have selected a delivery service and shipping destination, upon which they are automatically calculated and added to your order.
  3. Subject to section D.4, the price you pay is the price displayed on the relevant Service at the time we receive your order.
  4. In the unlikely event that the price of a product has been incorrectly advertised, we will contact you to ask whether you wish to proceed with the order at the correct price. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel the order. We will not be obligated to supply products at the incorrect price. E. Payment

  1. Payment can be made by most major credit or debit cards via PayPal™, personal check, or certified check (money order, cashiers check, etc). We do not accept cash. Further information on payment methods is available at http://www.verrice.com.
  2. We cannot accept your order until you have paid for it in full.
  3. Paid in full in respect to PayPal™ payments means that once the funds are marked as available by PayPal™ and we successfully transfer the funds to our bank.
  4. Paid in full in respect to checks (personal or certified) means once the funds clear our bank and become available.
  5. We cannot be held liable for any delays incurred due to payment.
  6. Should payment fail due to no error on our part, we reserve the right to cancel your order and / or close your account.
  7. By placing your order, you are agreeing that you can and will pay the amount displayed on your order or quoted to you by a telephone operative.

F. Delivery

  1. We deliver to the 50 official United States (unless otherwise specified). We are unable to deliver to international locations. International is defined as any location not residing within the 50 official United States of America.
  2. Details of our estimated timescales for delivery are available at http://www.verrice.com.
  3. We only process orders by you once payment has been authorized. If you are paying by check, your order will not be processed until your check has arrived and has been cleared.
  4. We will deliver directly to the address specified in your order. We cannot deliver products within the same order to multiple addresses.
  5. Once delivered, the products ordered will become your property (provided they have been paid tor in full) and your responsibility. Risk of loss and damage of products passes to you on delivery.

G. Returns and Cancellation

  1. Every product sold by CCbV is backed by our 30 day money-back guarantee ("30-Day Money-Back Guarantee"). We want you to be satisfied with your purchase. However, if you change your mind about a product or you would like to exchange your product, please contact CCbV by phone, or on http://www.verrice.com to obtain a Return Merchandise Authorization (RMA) number. With your RMA number you will receive instructions on where to send the product. You are responsible for any shipping costs associated with returning product.
  2. Under our 30-Day Money-Back Guarantee the purchase price will be refunded provided that the product is return in a clean, fully functional condition and in its original packaging. You should allow up to 21 days from receipt of your returned product at our location for your refund to be processed. We will normally refund you using the same payment method that you used to purchase the products, or issue you a credit which may be used for future purchases. Delivery charges will not be refunded.
  3. You also have a statutory right to cancel your purchase. If you wish to cancel you must tell us in writing, by telephone, email, or through the online Service at http://www.verrice.com, within 7 business days from the day after the date on which the product is delivered. You should keep evidence of having given your cancellation notice. You must take reasonable care of the product and you must return the product to us (at your own risk and cost) within 7 business days of notifying us of your cancellation. The product must be returned unused (except to the extent use was reasonably necessary to examine the product) and with the original packaging. The following products are excluded from this legal right to cancel: (i) audio/video recordings, DVDs or computer software that you have taken out of the sealed packaging in which they were delivered to you; (ii) any other products that by reason of their nature cannot be returned. We will refund the purchase price of the product together with the delivery charge you paid to receive the product.

H. Faulty or Damaged Products

  1. We will refund the purchase price together with the delivery charge for any product which is delivered in a damaged or faulty condition. Faults which occur after delivery will be handled through the individual component manufacturer's warranty if one exists. In a warranty situation CCbV will make every attempt to assist you in resolving the issue, but holds neither responsibility nor liability for the actions of original component manufacturers. Our involvement with original component manufacturer warranty claims is only a value-add service on our part, and not part of any contract or agreement made by you or with us upon ordering.
  2. Alternatively, and at your option, CCbV will replace the product with the same or similar product. See Section G "Returns and Cancellation" for information on obtaining a Return Merchandise Authorization and credit.
  3. We reserve the right to refuse to issue a refund / replacement product and to recover the cost of the return delivery from you in the event that the product is found to have suffered damage after delivery or has been misused or used other than in accordance with the instructions or if the problem is due to normal wear and tear. We do ask that damaged or faulty products are returned promptly.

I. Product Information

  1. We have taken reasonable steps to display as accurately as possible the colors and other detailing of our products. However, the actual colors and detailing you see on screen will depend on the equipment you use to view the products. We cannot guarantee that your display of any color or other detailing will exactly reflect the color or detailing of the product upon delivery.
  2. Any information regarding sizing of products is included as a guide only. If you are in any doubt as to the size of any product you require, we recommend that you contact us prior to placing and order.

J. Age-restricted products

  1. If you wish to order a product where a minimum age requirement is indicated, you must confirm that you are of the required age before you will be able to proceed with the order. We reserve the right not to supply any age-restricted product where we reasonably believe that you are below the relevant minimum age.
  2. For certain age-restricted products only certain specified payment methods may be allowed.

K. Our liability

  1. We will not be liable to you where performance of any of our obligations is prevented or restricted by any circumstances or cause beyond our reasonable control.
  2. You are responsible for the use you make of the products you order. To the extent not prohibited by law, we accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).
  3. We accept liability for death or personal injury caused by our negligence and responsibility for fraudulent misrepresentation and any other liability that cannot, under US law, be excluded.

L. General

  1. Custom Computer by: Verrice (CCbV) is a dba name for "Rangval Walker III", a sole-proprietorship registered in the state of Illinois with an IBT # of 3928-5685. Our contact details are set out in Section M below.
  2. Any formal legal notices should be sent to us at the address at the end of these Terms and Conditions by US Postal Service or by email and confirmed by US Postal Service.
  3. Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms and Conditions.
  4. If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and shall remain in force.
  5. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of the Services shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us or our licensors.
  6. You may not assign or sub-contract any of your rights or obligations under these Terms and Conditions or any related order for products to any third party unless agreed upon in writing by CCbV.
  7. CCbV reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these Terms and Conditions or any related contract to any third party.
  8. You and we agree that U.S. law applies to these Terms and Conditions and that any dispute between us arising out of or in connection with these Terms and Conditions will only be dealt with by the U.S. courts.
  9. All interactions with CCbV will be conducted in English.
